Trading Terms
1. This application and agreement is made by the applicant to A.P. Technologies Pty Ltd, in order to obtain trade credit. A.P. Technologies Pty Ltd reserves the right to decline the application and in the event that credit is extended to the applicant, to change or revoke the applicants credit limit on the basis of changes in A.P. Technologies Pty Ltd credit policies or applicants financial position and/or payment record.
2. All sales of product and services by A.P. Technologies Pty Ltd to the applicant are subject to A.P. Technologies Pty Ltd standard sales terms and conditions as at the time of the order. Any variance from those terms and conditions will be effective only if agreed to in writing by A.P. Technologies Pty Ltd prior to the time the product or services are ordered.
3. All orders for product must be made on the applicant’s official company purchase order document and should include the product code, product description, unit price, quantity required, freight and total price.
4. The applicant agrees to make payment to A.P. Technologies Pty Ltd in full for all amounts when due according to A.P. Technologies Pty Ltd invoices that are based on the applicants purchase orders. Applicant also agrees to pay A.P. Technologies Pty Ltd, as interest an amount equal to 1.5% per month, or the maximum provided by the law (whichever is the less) for invoice amounts that are past due.
5. Should the applicant default in any such payment(s), A.P. Technologies Pty Ltd shall have the right, without notice to the customer, to declare all invoice amounts due and payable. In the event that A.P. Technologies Pty Ltd should commence any action or actions, or otherwise seek to enforce this agreement against the customer, the customer agrees to pay any legal fees, court costs and other expenses incurred by A. P. Technologies Pty Ltd to recover the debt, whether or not a statement of claim is filed.
6. This agreement is strictly confidential and is not transferable or assignable without prior written consent of A.P. Technologies Pty Ltd A.P. Technologies Pty Ltd. Customer agrees that any change in liability for any debts incurred to A.P. Technologies Pty Ltd due to a change in the customers form or business, shall not be effective as to A. P. Technologies Pty Ltd until A.P. Technologies Pty Ltd receives actual notice of the change by certified mail.
7. Applicant hereby authorises the release of credit and payment history information to A.P. Technologies Pty Ltd by the references listed on this application.
